Terms of Use

Alderun is made by SquirrelFM, the studio name of Innova Inc. In these terms “we”, “us” and “our” mean Innova Inc., which is the company you are agreeing with. These terms are the agreement between you and us for playing the game. They are written to be read, not to be survived — if something here is unclear, write to us and we will explain it.

These terms cover the game. Posting on the player forum is covered by its own forum rules and terms, which you accept separately the first time you sign in there.

1. Playing the game

We give you a personal, non-exclusive, non-transferable right to install and play Alderun for your own entertainment. We do not sell you the game itself — the game and everything in it (code, art, sound, names) stays ours.

You may not sell, rent or redistribute the game, and you may not modify it, take it apart or work around its technical limits, except where the law gives you that right regardless of what an agreement says. Section 4 sets out what that means in detail, and what happens if you do it anyway.

2. Your account

You can play as a guest with no account at all. If you register, you must be at least 13, the email address must be yours, and you are responsible for what happens under your account. One person, one account — do not share it, and do not use someone else's.

We identify your device with a random identifier the game generates. If you lose access to your email address you may lose access to your account, because a code mailed to that address is the only way we can move an account to a new device.

An account is not property and may not be traded. You may not buy, sell, gift, rent, lend, transfer or offer an account, a display name, or access to either, and we will not recognise any such transfer. An account obtained that way may be closed without compensation to anyone.

If we suspend or close an account, you may not evade that decision — by registering another account, using someone else's, or using a different device or identifier. Doing so is itself a breach of these terms, and any account used to evade may be closed as well.

If you are a parent or guardian and you allow a person in your care to use the game or your device, you are responsible for their use of it and for any charge they incur, whether or not you authorised the particular purchase.

3. How you must behave towards other players

Alderun is played with other people, and this section is a material term of this agreement. It applies everywhere another player can see or hear you — matches, lobbies, chat, and the display name you choose — and it applies whether or not an automatic filter catches what you did. You must not:

We will suspend or permanently close any account used in breach of this section. We may act immediately and without prior notice where the conduct is serious, repeated, or directed at a person or group, and we may remove any name, message or content involved without notice. We may take the same action where conduct elsewhere — including on our player forum — gives us reasonable grounds to believe you present a risk to other players. Discrimination, threats of violence, sexual content involving a minor, and the exposure of another person's private information are serious breaches for the purposes of section 5: an account closed for them loses anything bought with it, and will not be reinstated.

The game filters obviously offensive names and chat automatically. That filter is a convenience, not the standard — conduct that gets past it is still a breach, and conduct it catches is not excused by having been caught.

4. Cheating, reverse engineering and unauthorised modification

This section is a material term of this agreement. You must not do any of the following, must not attempt to do it, and must not help, enable or permit anyone else to do it:

We will suspend or permanently close any account used in breach of this section, and we may do so immediately and without prior notice where the breach is serious, repeated or ongoing, or where it affects other players or the integrity of the service. A closure under this section is a closure for a serious breach for the purposes of section 5, so anything bought with the account is lost and no refund is due from us. We may additionally remove or reset any account, progress, standing, statistic or reward obtained or affected by the breach, block the devices and identifiers associated with it, refuse to supply the service to you in future, and pursue any other remedy available to us at law.

Nothing in this section restricts anything you are entitled to do under mandatory law that cannot be excluded by agreement, including any right to decompile the game for interoperability purposes to the extent that right applies to you and its statutory conditions are met. Reporting a bug, exploit or security vulnerability to us is not a breach of this section and is welcome; exploiting it, or publishing it before we have had a reasonable opportunity to fix it, is.

5. Suspension and closing accounts

If an account breaks these rules we may limit it, suspend it, or close it. We will act proportionately and, where we reasonably can, tell you why. You may close your own account at any time from the Account screen; that is immediate and permanent.

If we close an account for a serious breach, anything bought with it is lost. If we close it for any other reason, or we stop running the game, we will not treat purchases that way.

Whether a breach has occurred is our reasonable determination, made on the evidence available to us, including our own detection systems and match records. We are not obliged to disclose how a breach was detected, and we may decline to do so where disclosure would help others evade detection. Nothing in this section requires us to take action, and choosing not to act on one occasion does not prevent us acting on another.

We may also suspend or close an account where a payment made for it is reversed, charged back or otherwise not completed, and where an account has been inactive for 180 days or more we may delete it and the data associated with it. In each case, no compensation is due.

6. Purchases and in-game items

Any in-game currency or item is a licence to use it inside Alderun. It is not property, it has no value outside the game, it cannot be exchanged for money, and it cannot be sold or transferred to another player.

Purchases are handled by the store you bought through (Apple, Google or Steam), and their refund rules apply. Nothing here affects the refund and cancellation rights consumer law gives you. Subject to those rights and to the store's own rules, a purchase is final once it completes, and an item that has been used or consumed is not refundable by us.

We may change the game, and we owe you nothing for the change. We may add, alter, rebalance, restrict, withdraw or remove any feature, mode, map, hero, item, price or in-game currency at any time, including one you have paid for, where we do so for a legitimate reason — balancing the game, fixing a fault, meeting a legal or platform requirement, protecting players, or ending a feature we no longer support. Except where consumer law requires otherwise, no refund, credit or other compensation is due for a change of that kind, and none is due for unused items when an account is closed or when we stop running the game.

7. What you write, and what you send us

You keep what you write — your name and your chat messages are yours. You give us permission to transmit and display them to other players so the game works. You are responsible for what you send, and you must have the right to send it.

We do not routinely store chat — our Privacy Policy says what happens to it — but nothing in these terms obliges us to carry a message. We may filter, block, refuse to transmit, or remove any message or display name, and we may review and retain a particular message where we reasonably need it to investigate a suspected breach of these terms, to protect a player, or to comply with the law. We do not pre-screen what players send and we are not responsible for it; a message is the responsibility of the player who sent it.

Feedback. If you send us an idea, suggestion, bug report, design proposal or other feedback — by any route, in the game, by email, or on our forum — you grant us a worldwide, perpetual, irrevocable, non-exclusive, transferable, sub-licensable, royalty-free licence to use it for any purpose without restriction, and we owe you no payment, credit or confidentiality for it. We may already be working on the same thing. This does not affect any moral right you cannot waive, and it does not take ownership of anything else you have made.

8. The game is an online service

Alderun needs our servers for multiplayer, and online services change. We may update the game, change or remove features, take servers down for maintenance, or eventually stop running the online part altogether. We will give reasonable notice before shutting the service down where we can. Single-player does not depend on our servers.

Alderun is pre-release software. While the game is in test, alpha, beta or early access, it may contain faults, may behave unpredictably, and may change substantially. Accounts, progress, statistics, standings and unlocked content may be reset or deleted as part of testing, and no compensation is due for that.

We do not promise to preserve your data. We keep reasonable backups of our own systems, but we do not guarantee that an account, its progress or anything else will survive a fault, a reset, a device change or a loss of access to your email address, and we are not obliged to restore any of it.

9. Health warning

A very small number of people may experience a seizure when exposed to flashing lights or patterns, including while playing a video game, and may do so with no previous history of epilepsy. Stop playing and consult a doctor if you experience dizziness, altered vision, eye or muscle twitching, disorientation, involuntary movement, or loss of awareness. Take a break of at least fifteen minutes every hour, play in a well-lit room, and do not play when tired. If you are pregnant, elderly, have a heart condition, or have a history of seizures, seek medical advice before playing.

10. No promises we cannot keep

The game is provided as it is. We do not promise it will be uninterrupted, error-free, or compatible with every device, and we do not promise a particular quality of match connection. This does not affect any legal guarantee you have as a consumer that cannot be excluded.

11. Your responsibility to us

If someone else brings a claim against us because of something you did, you will defend us against it and cover it. In full: you agree to indemnify and hold harmless Innova Inc., its officers, employees and contractors against any claim, demand, proceeding, loss, liability, damages, fine, cost and expense (including reasonable legal fees) arising out of or connected with your breach of these terms, your misuse of the game or our services, anything you send or say through them, or your infringement of anyone else's rights.

This does not apply to the extent the claim is caused by our own breach or negligence, and it does not apply to a consumer to the extent the law where you live does not permit it. We will tell you promptly about any claim we want covered, will not settle it without asking you first, and will let you take over the defence where it is reasonable for you to do so.

You also acknowledge that a breach of section 3 or section 4 may cause us harm that money cannot adequately repair, and that we may seek an injunction or other equitable relief for it, in addition to any other remedy.

12. Our liability

We are responsible for loss we cause by breaking this agreement or by failing to use reasonable care, but only for loss that is a foreseeable result of it. We are not liable for lost profits, lost progress, or losses that were not foreseeable. Where the law allows a limit to be set, our total liability to you, for all claims taken together, is limited to what you paid us in the six months before the claim arose, and in no event to more than USD 100 — so if you have paid us nothing in that period, which is the case for everyone playing free, the limit is nil.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep every right your local law gives you, and nothing here takes those away.

13. Which law applies

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules, and the state and federal courts located in King County, Washington are the agreed place for disputes.

If you are a consumer outside the United States this does not take away the protection of the mandatory law of the country where you live, and you may still bring proceedings in your own country's courts. Nothing here removes a right your local law gives you and does not allow you to give up.

Time limit. Except where the law where you live gives you longer, any claim arising out of these terms or your use of the game must be brought within one year of the date on which it arose, or it is permanently barred.

14. Export control and sanctions

The game is supplied from the United States and is subject to US export control and sanctions law. By using it you confirm that you are not located in, ordinarily resident in, or acting on behalf of a country or territory subject to comprehensive US sanctions, and that you are not on any restricted-party list maintained by the US government or by any other applicable authority. You must not use, export or re-export the game in breach of that law, or in support of money laundering, terrorism or the development of weapons.

15. Changes to these terms

If these terms change, the new version is published on this page with a new date. If a change materially affects your rights we will tell you in the game before it takes effect. Continuing to play after that means you accept the new version; if you do not, you can delete your account.

16. General

If part of this fails, the rest stands. If any provision of these terms is held to be invalid or unenforceable, it is to be read down to the least extent needed to make it valid, or severed if that is not possible, and every other provision remains in full force.

Whole agreement. These terms, together with our Privacy Policy, are the entire agreement between you and us for the game and replace anything said or written before. Nothing in this paragraph limits liability for fraud or fraudulent misrepresentation.

No waiver. If we do not enforce a provision, or delay in doing so, that is not a waiver of it, and it does not prevent us enforcing that provision or any other later.

Transfer. We may transfer or assign this agreement, in whole or in part, to another company — for example on a sale, merger or reorganisation — provided your rights under it are not reduced. You may not transfer or assign it, or any account or right under it, without our written consent.

Things outside our control. We are not liable for any failure or delay caused by something beyond our reasonable control, including an outage, network or hosting failure, act of a platform or payment provider, power failure, natural event, epidemic, industrial action, war, terrorism, act of government, or attack on our systems.

No partnership, and no third-party rights. These terms create no partnership, agency, employment or joint venture between us, and nobody other than you and us may enforce them, except that the people named in section 11 may rely on that section.

Notices. We may give you notice in the game, at the email address on your account, or by publishing it on this website, and a notice is treated as given when sent or published. You give us notice at the address on our contact page.

Survival. Sections 1, 4, 6, 7, 10, 11, 12, 13, 14 and 16 survive the end of this agreement, however it ends.
